terms and conditions
This programme, rewards, privileges, or terms and conditions in respect of "[shu for me]]" (“Membership”) is organised by [shu uemura]] under the Organiser, L’ORÉAL MALAYSIA SDN. BHD. (Company No. 199401042730/328418-A), This Membership shall be governed by the Specific Terms and the General Terms as particularly detailed hereinunder.
The Membership period will take effect from its registration date and shall continue to run for a period of 12 months (“the Membership Period”), subject to minimum points accumulation, unless terminated by the Organiser at any time without liability to the Member.
shu for me membership is available for 3 tiers:
- nishiki Bronze: RM 1 – RM 499 accumulative spend within 12 months
- tokyo night silver: RM 400 – RM1,499 accumulative spend within 12 months
- makie gold: RM 1,500 accumulative spend within 12 months
To maintain membership status, members will need to spend no less than the following amount:
- nishiki Bronze: RM 1 – RM 400 within 12 months from the date the member is qualified
- tokyo night silver: RM 400 within 12 months from the date the member is qualified
- makie gold: RM 1,500 within 12 months from the date the member is qualified
Member will earn points acceleration according to tiers:
- bronze member: RM 1 = 1 point
- silver member: RM 1 = 1.2 point
- gold member: RM 1 = 1.3 point
Points earned for paid makeup / brow services are:
- bronze member: RM 1 = 1 point
- silver member: RM 1 = 1.2 point
- gold member: RM 1 = 1.3 point
Accumulation of Points and Validity
Points accumulation shall be effective from Membership registration date and includes the points from the first purchase.
To earn points, only Members who have registered are eligible to earn points every time a purchase is made. Membership points reflection takes at least 24 hours from purchase, the Organiser reserves the right to reject any request to issue points after a transaction has been made.
Points are valid for 1 year from the date when the Member’s first transaction. Upon points expiry, Member is given a 30 days grace period to utilize their points. Points are considered null and void after the 30 days grace period. Please note that the Organiser is not obliged to give notice to Member on the points expiry and/or the 30 days grace period.
To earn points, Members are required to present their Membership ID and inform shu uemura beauty advisors of their Membership every time a purchase is made at any shu uemura boutique, kiosk, counter, shu uemura on Lazada and social commerce platform in Malaysia.
Points are earned and accumulated, strictly through the purchase of any shu uemura products at shu uemura boutique, kiosk, counter, shu uemura on Lazada and social commerce platform (shu uemura Malaysia Official Facebook page Messenger) in Malaysia.
Membership points and privileges are non-transferable and non-exchangeable for:
- cash (in full or in part),
- non-designated products or
- non-designated rewards (as defined hereafter) and may only be used by the members for purposes outlined in the programme
Members may use points collected to redeem for the relevant rewards (“rewards”). The rewards may be limited in supply and they will be rewarded on a first come first serve basis.
Rewards are referred to e-voucher/product redemption. Upon redemption of the e-voucher/product, members will have a validity of 30 days to use before it expires, there will be no extension allowed once voucher has expired.
An automated SMS will be sent to you upon redemption. This SMS is to be used as the redemption proof.
Not valid with promotions and other shu uemura vouchers. Not valid for services. Subjected to changes at the brand’s discretion.
Vouchers can only be used if the min. top up amount to the purchase is RM 1.
Product redemption will take 1 month for processing, an sms will be blasted to notify the member once the item is ready for collection at the selected boutique.
Once a request for rewards has been submitted, the request may not be changed, and points deducted will not be reversed.
The company reserves the right to replace the rewards with another product of similar value in the event of unavailability without prior notice to the members.
All welcome gifts and birthday gifts are only awarded to customers or members that either upgrades to the new tier or joins silver/ gold tier for the first time.
All welcome gifts and birthday gifts are subject to change according to availability, the management reserves the rights to change the gifts from time to time without prior notification.
In these General Terms of Membership, “Organiser” means L’Oréal Malaysia Sdn Bhd (Company No. 199401042730/328418-A), a company incorporated and validly existing under the laws of Malaysia and having its business address at Crown Penthouse, 1 Powerhouse, No. 1, Persiaran Bandar Utama, Bandar Utama, 47800 Petaling Jaya, Selangor Darul Ehsan, Malaysia. “Member” means the person, registered for the Membership. “Membership” means a loyalty program where a Member enjoy benefits, privileges and rewards as describe in this Terms and Conditions.
The programme, rewards and privileges in respect of the Membership is open to any Malaysian citizen and resident, eighteen (18) years old and above, with a valid MyKad and residential address in Malaysia (“Member”).
Each application to become a Member is subject to a minimum purchase of “[RM 1]” worth of products and/or services in a single receipt at any [shu uemura] boutiques, kiosks, counters, shu uemura on Lazada and social commerce platform ([shu uemura] Malaysia Official Facebook page Messenger) in Malaysia.
The Organiser reserves the right to exclude, disqualify and/or reject any application for Membership if it reasonably determines in its sole discretion that the member:
- does not satisfy the eligibility criteria of the “Member” in clause 2 or unable to provide proof of eligibility to register in the Membership for verification by Organiser when requested;
- in breach of these Terms and Conditions or violate any applicable laws/regulations; and/or
- undermines, has or attempted to undermine the operation of the Membership by fraud, cheating or deception.
By submitting an application as Member to this Membership, the person is deemed to have carefully read, understood and agreed to be bound by the Terms and Conditions of this Membership.
All Members are subject to the terms and conditions of the Membership which may be changed, revised, supplemented, suspended, withdrawn or terminated by the Organiser at any time without prior notice. Members are entitled to enjoy the relevant benefits and privileges of the Membership throughout the Membership Period.
All costs and expenses incurred and/or arising from the participation in the Membership, including without limitation, telecommunications, network, Short Messaging Services (“SMS”), postal and all such other charges and out-of-pocket expenses as may be incurred by the Member during or in connection with the Member shall be borne by the Member.
Rights of the Organiser
The Organiser reserves the right in its sole discretion, change the terms and conditions including to change any of the terms and conditions of this Membership unilaterally, at any time, including but not limited to, change on the Membership period, cancel/revoke points collected, change the validity period of points, make reward substitutions, suspend or revoke any membership account and/or cancel, terminate or suspend the Membership in whole or in part, without prior notice and without liability. In the event of any changes to the terms and conditions, Members agree that their continued participation in the Membership will constitute their acceptance to the terms and conditions and any variation thereof.
The Organiser reserves the right in its sole discretion, without prior notice and without any liability to any person, at any time to suspend, cancel or revoke any Membership account.
The Organiser’s decision on all matters relating to the Membership shall be final, binding and conclusive on all Members, and no correspondence or appeals will be entertained.
The Organiser reserves the rights to hold promotional campaigns related to membership points at any given time without Member’s prior notice.
Each Member agrees to indemnify, release and hold harmless each of the Organiser, its holding, subsidiary or related companies, directors, officers, employees, agents, sponsors and/or representatives against any and all losses, rights, claims, actions and damages (including special, indirect and consequential damages) arising from or incurred as a result of the Member’s participation in the Membership, acceptance of any reward, and/or violation of these Terms and Conditions.
Limitation of Liability
The Member’s participation in the Membership shall be at the Member’s own risk.
The Organiser, L’Oréal Group and/or its affiliates, its, directors, officers, employees, agents, sponsors and/or representatives shall not be liable to any Member in respect of any loss or damage whatsoever which is suffered, including but not limited to indirect or consequential loss, or for personal injury suffered or sustained by the Member arising out of or in connection with the participation by the Member in the Membership, as well as the redemption and/or utilisation of any reward won.
Member shall assume full liability and responsibility in case of any liability, mishap, injury, damage, claim or accidents (including death) resulting from their participation in this Membership, redemption and/or utilization of the reward.
All transportation, accommodation, personal costs and/or any other costs, fees and/or related expenses that are incurred to participate in this Membership and to redeem the reward is the sole responsibility of the Member(s).
The Organiser shall also not be responsible for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction, unauthorized access to, or alteration of, user or member communications, or any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of e-mail or players on account of technical problems or traffic congestion on the Internet.
Except to the extent that they may not be excluded by law, no representations, warranties, terms or conditions that are not expressly stated in these terms and conditions apply to this Membership nor in respect of the reward and all implied warranties are excluded, including but not limited to, the implied warranties of satisfactory quality, merchantability or fitness for a particular purpose of any of the reward.
Data Protection and Privacy Notice
To the extent permitted by applicable law, the Member may request for access to or correction of the Personal Data or limit the processing of the Personal Data at any time hereafter by submitting such request to the Organiser via e-mail to Customer Hotline at [email protected] or by contacting Customer Hotline at 1-300-22-2232. Please note that it will be necessary for you to provide all of the Personal Data, without which we will not be able to process the same for the Purpose.
The Organiser, its agents, sponsors and/or representatives shall not be liable to perform any of their obligations in respect of the Membership and the Terms and Conditions where they are unable to do so as a result of circumstances beyond their control and shall not be liable to compensate the Member in any manner whatsoever in such circumstances.
The Member shall not be entitled to assign any of the rights or sub-contract any of the obligations herein. The Organiser shall be entitled to assign or sub-license the whole or any part of its rights hereunder to any third party as may be determined by the Organiser.
The invalidity, illegality or unenforceability of any terms hereunder shall not affect or impair the continuation in force of the remainder of the Terms and Conditions of the Membership.
By participating in the Membership, Member agree to be bound by the decisions of the Organiser. Member(s) who violate any rule, gain unfair advantage in participating in the Membership, or obtain reward(s) using fraudulent means will be disqualified. Disruptive, annoying, harassing or threatening behaviour is prohibited. The Organiser will interpret these rules and resolve any disputes, conflicting claims or ambiguities concerning the rules or the Membership and the Organiser’s decisions concerning such disputes shall be final. All decisions will be made by the Organiser and are final.
The Organiser may waive any of these rules in its sole discretion. Any attempt by a Member or any other individual to deliberately circumvent, disrupt, damage or undermine the legitimate operation of this Membership is a violation of criminal and civil laws. Should such an attempt be made, the Organiser reserves the right to seek civil and/or criminal prosecution and/or damages from any such person to the fullest extent permitted by law.
The Terms and Conditions of the Membership shall be construed, governed and interpreted in accordance the laws of Malaysia, and shall be subject to the exclusive jurisdiction of the courts of Malaysia.
